    Government Affairs Committee Meeting

    Overtime Rule:
New overtime rules requiring some salaried employees to get time-and-a-half compensation for working overtime go into effect Dec. 1. Under the new rules, salaried employees making less than $47,476 per year will get time-and-a-half compensation for the time they work more than the regular 40-hour work week. This new threshold more than doubles the current salary level of $23,660, and is subject to change again every three years.

The new overtime rule applies to any entities or individuals who are subject to the Fair Labor Standards Act. Unlike Title VII or the Americans With Disabilities Act, both of which apply to companies with 15 employees or more, the FLSA applies to any enterprise with an annual gross volume of sales or business totaling $500,000 or more, plus hospitals, schools and government agencies, as well as individual employees engaged in interstate commerce or in producing goods for interstate commerce.

Don’t think your workers are engaged in interstate commerce? Guess again. According to the Department of Labor’s eLaws website, engaging in or producing goods for interstate commerce includes, among other activities, using a phone, fax, U.S. mail or email to communicate across state lines; authorizing credit card purchases; providing security at an airport; and even performing janitorial work in a bus terminal. And the Labor Department estimates that of the 4.2 million workers the rule will affect, 1.6 million work for small entities. So your best bet is to assume the rule applies to you, and get cracking on complying. Come hear how you can prepare and what you should expect from this new rule.

Also we will be going over our GNDC Legislative Agenda, as we prepare for the next legislative session.
